Lands Ministry Lifts Two-Month Suspension on Special Certificates of Title, Unveils New Rules to Stop Land Fraud

The Ministry of Lands, Housing and Urban Development has lifted the suspension on issuing special certificates of title, paving the way for applications to resume under new guidelines intended to protect landowners and curb fraudulent land claims across Uganda. The decision follows a suspension announced on August 14, 2026, after members of the public raised concerns about alleged cases in which people were losing their land through the misuse of special certificates of title.

The Ministry suspended the process to review existing procedures and establish stronger safeguards against individuals attempting to acquire or interfere with properties they do not legally own.On October 20, 2026, the Minister of Lands, Housing and Urban Development announced that the suspension had been lifted after the Ministry reviewed the procedures governing the issuance of the documents. The revised guidelines are intended to strengthen the verification process, improve transparency and reduce opportunities for people to exploit weaknesses in the land registration system. The Ministry noted that Section 69 of the Registration of Titles Act provides for the issuance of special certificates of title. However, concerns have been raised about the lack of sufficiently detailed procedures to guide every stage of the process and prevent fraudulent applications.Special certificates of title are issued through a legal process that allows landowners to seek replacement documentation when their original certificates are lost or unavailable. The process is important because land titles provide evidence of registered ownership, but weaknesses in verification can expose property owners to disputes and possible fraud.Under the revised guidelines, the Ministry intends to strengthen the checks carried out on applications before special certificates of title are issued.

The measures are designed to help officials identify suspicious claims, protect legitimate ownership interests and ensure that applicants follow the required procedures. The Minister said the changes are aimed at safeguarding property rights and strengthening land ownership security in line with the 1995 Constitution of Uganda. The Ministry expects the revised framework to help genuine landowners obtain replacement documents while making it more difficult for fraudulent applicants to exploit the system. With the suspension now lifted, applicants can resume pursuing special certificates of title in accordance with the new guidelines.

However, the resumption does not mean that applications will automatically be approved, as they must still satisfy the applicable requirements and verification procedures. The Ministry is also planning consultations with relevant stakeholders to collect feedback on the guidelines and identify areas that may require further improvement. These discussions are expected to contribute to the development of a stronger and more reliable process for handling applications. After the consultations, the Ministry plans to translate the guidelines into formal regulations.

This is expected to provide a clearer framework for the issuance of special certificates of title and strengthen accountability in the administration of replacement land documents. The lifting of the suspension is an important development for landowners who need replacement certificates, particularly those whose applications were affected by the temporary halt. At the same time, the new measures place greater emphasis on protecting legitimate property rights and preventing abuse of the registration process. As Uganda continues to grapple with land disputes and allegations of fraudulent property transactions, the effectiveness of the new guidelines will depend on consistent enforcement, careful scrutiny of applications and the ability of the authorities to address suspected fraud before it threatens lawful ownership.
